Simon San killer John Reid is back in jail

SCOTLAND's justice system has come under fire after it emerged that a killer who felled a takeaway driver has been jailed again.

John Reid spent just three years in a young offenders’ institute after killing Simon San with a single punch outside his family’s restaurant in Lochend in 2010.

He was released in 2013 – before being sent back to jail the following year after breaching his parole.

It has now emerged that Reid, 22, was earlier this month sentenced to another 12 months behind bars after being found guilty of breaking into two houses.

The development has angered Scottish Conservative shadow justice secretary Douglas Ross, who said Reid’s original sentence for killing Mr San had been too light.

He said: “People were horrified when this individual served only three years for what was a horrific crime.

“Since then he’s proved those people correct, breaking into two homes and now finding himself in jail again.

“This is why it’s so important that we get sentencing right. If dangerous criminals are released too early, they wander straight back into a life of reoffending, making even more people’s lives a ­misery.

“The latest regrettable twist in this case proves that very point.”

Mr San, 40, was felled by a single punch from Reid after being set upon by a group of youths outside his family’s Yong Hua Garden Chinese in Lochend on August 11, 2010.

Reid was sentenced to five years’ detention at the High Court in Glasgow after he pleaded guilty to culpable homicide.

Two other teenagers – Michael Roberts and Keir Rodger, both 16 at the time – were sentenced to 24 months and 26 months respectively.

Reid appeared at Edinburgh Sheriff Court earlier this month, where he admitted breaking into houses in Corstorphine and Morningside on February 17 this year and stealing a laptop, mobile phone, camera and cash.

A 17-year-old co-accused, who can’t be named for legal reasons, was sent to jail for 16 months for breaking into homes in Barnton, Corstorphine and Kingsknowe.

They were both described in court as prisoners at Polmont Young Offenders’ Institution.

The killing of Mr San in 2010 shocked the country and eventually led to his family lodging an official complaint with police, saying that they frequently phoned to alert officers to youths targeting him and others at the takeaway before his death.

An internal inquiry then found “significant failings” in the police’s repeated denials that the killing was racist.

Deputy Chief Constable Steve Allen made a high-profile public apology for the force’s failings.

John’s brother Gary Reid, 20, was jailed last year for attacking Chinese takeaway owner Jie Yu, who was stabbed in West Pilton in October 2014.
