Driver’s sex attack after victim thought he was taxi

A motorist was jailed for three years today after driving a woman who had left a fancy dress Hallowe’en party into a dead end street and sexually assaulting her.

Kevin Allan climbed on top of the victim who was under the influence of drink during the indecent assault.

Allan, 48, of Oxgangs Street, Edinburgh, was cleared of raping the woman by a jury at the High Court in the city and an allegation that he pretended to be a private hire taxi driver.

But he was found guilty of driving the woman and her sister down a dead end street and asking them to perform sex acts on him.

Lord McEwan told Allan, the registered carer for his partner, that he had been convicted of a lesser charge than the one he originally faced, but added it was still “a very serious matter”.

The judge also ordered that he should be placed on the sex offenders’ register.

The victim told the court that she had been out at a club in Edinburgh but did not remember how she got home afterwards.

The 25-year-old said: “I can’t remember. Maybe I had a lot to drink. I can’t remember because I banged my head.”

The woman told Allan’s trial: “I don’t have sex with strangers.”

The woman had worn a pirate outfit to the club where they mingled with others dressed as zombies and a gangster.

They had been drinking cocktails, as well as shots and syringes with alcohol in them.

As they made their way home one of them hailed a car, thinking it was a taxi. The vehicle stopped and they got in, but it was driven to Glen Street.
